How North Carolina Law Applies to Mothers’ Rights
North Carolina no longer presumes that mothers are the more suitable parent for young children. Every custody case is decided under a gender-neutral best interests of the child framework, which means a mother’s rights are evaluated by the same factors applied to a father: the home environment, caregiving history, involvement in education and daily life, stability, and the ability to support the child’s relationships with both parents.
The practical effect is that a mother who has been the primary caregiver has a documented history the court can evaluate, but that history must be organized and presented effectively. Mothers who were less involved in day-to-day caregiving still have full standing to seek custody arrangements that serve their child’s needs.
For unmarried mothers, North Carolina law provides an important baseline: a mother is presumed to have full physical and legal custody of her child from birth unless and until a court orders otherwise or the father establishes paternity through a legal proceeding. Once paternity is established, both parents stand on equal footing, and the case proceeds under the best interests standard.
Custody Rights for Raleigh Mothers
Child custody involves two distinct questions. Legal custody governs who has authority to make major decisions for a child, including education, healthcare, and religious upbringing. Physical custody governs where the child primarily lives. Courts can award either or both on a sole or joint basis depending on what best serves the child.
Wake County requires parents to complete mandatory custody mediation before a contested hearing can be scheduled. We prepare mothers for that process, and because Attorney Bailey holds certification as both a Family Financial Mediator and a Superior Court Mediator, we approach that stage with a practical understanding of how these sessions work and what they can accomplish.

For many mothers, separation raises immediate financial concerns, particularly when one spouse reduced income or paused a career to serve as the primary caregiver. North Carolina law addresses this through several distinct mechanisms.
Post-Separation Support & Alimony
A dependent spouse may be entitled to post-separation support and alimony under NC law. Courts weigh each spouse’s earning power, the standard of living established during the marriage, each party’s assets and liabilities, and the extent to which caregiving responsibilities affected a spouse’s financial standing. Marital misconduct can also affect eligibility under North Carolina General Statutes Chapter 50.
Child Support
Child support is calculated using state guidelines that account for each parent’s income and the proportion of time the child spends with each parent. Support orders can be modified if income or custody arrangements change substantially.
Equitable Distribution
North Carolina starts from a presumption that marital property is divided equally, but courts may deviate based on relevant factors including each spouse’s contributions to the marriage. Attorney Bailey’s certification as a Family Financial Mediator gives her training in asset valuation and financial dispute resolution. We also connect clients with financial advisors when long-term planning requires knowledge beyond the legal process itself.
Domestic Violence Protective Orders in Wake County
When a mother’s safety is at risk, the law provides tools that can act quickly. A 50B domestic violence protective order under North Carolina Chapter 50B can include provisions addressing custody, housing, and no-contact requirements. Courts can issue one on an emergency ex parte basis, meaning a judge may grant the order without the other party present if immediate harm is shown.
Domestic violence history is also a factor North Carolina courts consider in child custody determinations. We represent mothers through every stage of obtaining and litigating these orders.
